COMPETITION RULES

  • This promotion is run by Wrigley Company Limited (Company Reg No. 00210533), Estover, Plymouth, Devon, PL6 7PR ("Wrigley"), in association with Vice Magazine Publishing Inc. ("VICE"). Wrigley is the sole promoter, and whilst VICE collaborates with Wrigley on this promotion, it does not share rights or responsibilities in running the promotion individually.
  • By entering this competition, all entrants will be deemed to have accepted these rules and any additional rules listed on this site or otherwise communicated.
  • No proof of purchase is necessary in order to enter the promotion. There is no fee charged to enter into this promotion other than the cost of you accessing the Internet which you would otherwise have.
  • Entrants must be 18 years or older and a resident of the United Kingdom to enter into this promotion and receive the relevant prize if you win. Wrigley reserves the right to request proof of age from entrants.
  • Entrants must not be employed by Wrigley, its affiliates and subsidiaries or must not be related to their families, or persons directly involved in the administration of this competition, including VICE and Wrigley's agencies GolinHarris, Bray Leino, AMV BBDO and MediaCom
  • Entrants will be deemed to be the natural person to whom the email address (provided on entry) is registered. Only one entry per person is permitted.
  • How to enter: To be eligible, you must submit your entry form and an example of or a link to your talent as detailed on the prize entry submission page at viceland.com/creatingsense5. Entries must be received no later than 23.59 hours (UK time) on 11 May 2009 (or such later closing date as may be notified to entrants on the promotional pages) at which time entry to this promotion will close. Entries received after this time will be deemed to be invalid.
  • The independent judges appointed by Wrigley and VICE, shall select up to five winners. Wrigley and VICE reserve the right to select less winners if the entries do not meet the required standards or criteria outlined on the prize entry submission page at 5/viceland.com
  • By entering into this promotion, you agree and acknowledge that:
  • Your piece(s) of creative may be displayed on the viceland.com/creatingsense5 site and/or on other VICE/Wrigley promotions;
  • You may be required to take part in publicity or such other promotional activities (such as media relations) which Wrigley and VICE may reasonably require in connection with the promotion.
  • Wrigley will cover expenses associated with showcasing the talent at the event such as raw materials, props, transportation of equipment
  • The prize for the competition is the opportunity to showcase your particular talent at the 5 launch event in June (exact date tbc). The event will be curated by Hot Chip who you will formally meet. ÊWinners will also win the right to bring 10 persons of their choice to the event as guests. Your work will also be showcased in the July issue of VICE magazine.
  • Shortlisted finalists will be contacted by Wrigley and VICE to determine their availability and suitability for the role (s) required
  • The final winners will be contacted by email and/or telephone (on the email address and telephone number(s) given with entry details) by Wrigley or their agents within 7 days of the closing date of the promotion.
  • Every reasonable effort will be made to reach the winners. If the winners cannot be contacted within 7 days of the closing date of the promotion, the opportunity to participate in the event will be awarded to another entrant at Wrigley's absolute discretion.
  • There are no cash alternatives for any prizes offered. Prizes are as stated and cannot be altered.
  • Runners up in the competition will be decided upon by the judging panel. Prize for this will be two tickets to the event which are not transferable or refundable. Every reasonable effort will be made to reach the runners up. If they cannot be contacted within 7 days of the closing date of the promotion, the opportunity to attend the event will be awarded to another entrant at Wrigley's absolute discretion
  • Prizes of tickets to cancelled or curtailed events may not be valid for re-scheduled dates.
  • Wrigley will cover the winners' travel to and from the event and accommodation at its sole discretion.
  • If you are selected as a winner and accept your prize, you agree and acknowledge that:
  • You will be in the United Kingdom and available to work with Wrigley and VICE to coordinate your participation in the 5 launch event between 11 May and 5 June 2009
  • You will be available to attend the 5 event on 3 or 4 June 2009 - date tbc
  • You will undertake a performance or demonstration of your talent at the event
  • You will arrive at the event in suitable time for you to set up any equipment or make any other preparations needed to adequately carry out your pre determined role. Arrival time to be determined and agreed in advance of the event
  • Participate in publicity or such other promotional activities, such as print and radio interviews, advertorials which Wrigley and VICE may reasonably require in connection with the promotion.
  • Wrigley will have exclusive rights to own and use all materials used for publicity (such as photography of the creative work or winners, filming of the creative work or interviews with the winners or information published about the winners) in any medium. By medium, this could include national newspapers (e.g. The sun, Daily Mirror etc), regional newspapers (e.g. Manchester Evening News), the internet (e.g. BBC London), broadcast (e.g. London Tonight news), blog sites (e.g. Music Bloggers United) and social networking sites (e.g. Twitter), both inside and outside of the UK. The winners' creative work could be commented on by journalists and members of the public globally.
  • Wrigley will own the rights to this material for a period of three months from the date of the launch party, however once the material is published it will remain in the public domain indefinitely
  • Your piece(s) of creative may be displayed at the event
  • Once your name, photo and talent are in the public domain, Wrigley has no control over who uses the information. For example online commentators such as bloggers may discuss your work
  • The judge's decision on all competitions is final and no correspondence will be entered into.
  • Your personal information such as name, age, regional origin and professional/creative background may be used by Wrigley and VICE to conduct the promotion and for participation in the prize and will be in the public domain. If you are a winner or a finalist, Wrigley and VICE may use the personal information you have submitted during the promotion for marketing or promotional purposes, including using your name and likeness to publish winner and finalist details. Wrigley cannot take responsibility for additional information (such as racial origin; sexual orientation, behaviour and history; political views or religious practices or similar) that entrants voluntarily offer in a media interview, entering the public domain.
  • Except as otherwise required by applicable law, neither Wrigley nor VICE are responsible for any injuries, loss, costs or damage associated with you entering into this promotion, the finalist and winner selection process or the provision or otherwise of any aspect of any prize or any act or omission of any other person or party, and all warranties, conditions and representations (of any kind) not expressly set out in these terms and conditions are hereby excluded.
  • Wrigley may terminate these terms and conditions, the promotion or any prize if you do not comply with these terms and conditions or are unlikely to do so, if Wrigley decides in its absolute discretion to withdraw the promotion before any winners are notified, or thereafter if any circumstances beyond Wrigley's reasonable control prevent or restrict Wrigley or any other person or party from providing the prize or any aspect of the prize.
  • If you cannot participate in any prize for reasons beyond your reasonable control, Wrigley requests that you notify Wrigley at your earliest possible convenience and Wrigley may in its absolute discretion allocate that prize to someone else.
  • You may not assign or transfer your rights or obligations, or subcontract your obligations, under these terms and conditions, such as transferring the right to a prize to anyone else, without Wrigley's prior written consent. Wrigley may assign or transfer its rights or obligations, or subcontract its obligations, under these terms and conditions without your consent.
  • Wrigley retains and reserves (a) all rights in and to the viceland.com/creatingsense5 site, and all aspects of the prize draw and each prize, including all derivatives, developments, modifications and improvements; and (b) the right to use the whole or any part of all piece(s) of creative that may be submitted by entrants for marketing and/or promotional purposes.
  • These terms and conditions, and any instructions from Wrigley, constitute the entire agreement between you and Wrigley, superseding any prior agreements between you and Wrigley. Any failure or delay by Wrigley, in exercising or enforcing, or partial exercise or enforcement of, any right or provision of these terms and conditions shall not constitute a waiver of such right or provision (or waive any further exercise or enforcement) or any other right or provision. If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision and the other provisions of the terms and conditions will remain in full force and effect.
  • These terms and conditions and all matters arising from or in connection with them are governed by English law and the courts of England will have exclusive jurisdiction in the event of any such dispute.
  • Wrigley reserves the right to amend the rules of any competition or cancel any competition at any time without prior notice.
